Entering the 100-day working period in the Red and White Cabinet, the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), Nusron Wahid, is focusing on regulating 537 companies/legal entities that have Plantation Business Permits (IUP) without Cultivation Rights (HGU).

He conveyed this in the first Working Meeting with Commission II of the Indonesian House of Representatives (DPR RI) on Wednesday (10/30/2024).

“The main sanction that will be applied is a tax fine, with the amount currently being calculated by the Financial and Development Supervisory Agency (BPKP).

Currently, the Ministry of ATR/BPN is regulating and evaluating, temporarily suspending the process of submitting registration and issuing HGU,” said Minister Nusron after explaining his 100-day work program at the DPR RI Nusantara II Building, Central Jakarta.

According to him, the actions of companies that continue to operate without permits reflect non-compliance with regulations.

“That’s what we discussed, it doesn’t mean that after they pay the fine they automatically get HGU. The final decision will depend on the good faith and attitude of the government,” explained Nusron Wahid.

Based on data from 2016 to October 2024, there were 537 palm oil companies that had IUP but did not have HGU.

“This is what we want to regulate within 100 days, it must be completed, if totaled there are 2.5 million hectares,” explained the Minister of ATR/Head of BPN.

According to him, the regulation was carried out to ensure compliance with previously existing regulations, namely the Constitutional Court Decision dated October 27, 2016 concerning Law Number 39 of 2014 concerning Plantations, especially Article 41.

“So previously those who were allowed to plant oil palms had to have IUP or HGU, now with the Constitutional Court decision it is those who have IUP and also HGU,” concluded Minister Nusron.

Also accompanying Minister Nusron on this occasion were Deputy Minister of ATR/Deputy Head of BPN, Ossy Dermawan and Senior High-Level Officials and Pratama in the Ministry of ATR/BPN.

This working meeting was also attended by the Chairman of Commission II of the Indonesian House of Representatives, Muhammad Rifqinizamy Karsayuda and all Deputy Chairmen of Commission II of the Indonesian House of Representatives along with a number of members.
