The polemic regarding the Building Use Rights (HGB) certificates issued above the sea continues to roll. Most recently, the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN), Monday (27/01)

Nusron Wahid, took a bold step by ordering the cancellation of a number of certificates that were suspected of violating coastal boundaries and had legal defects due to maladministration.

This step received appreciation from the Head of the Criminal Investigation Agency of the Indonesian National Police for the 2008–2009 period, Susno Duadji.

He said that this step was concrete evidence of the commitment of the Ministry of ATR/BPN in siding with the people.

“Mr. Nusron is truly siding with the people.

We really appreciate the open steps taken by the Ministry of ATR/BPN in resolving this problem,” said Susno Duadji in a teleconference session of the Primetime News Metro TV event, Friday (24/01/2025).

Susno Duadji added that the cancellation of the certificate by the Ministry of ATR/BPN can be used as a basis for Law Enforcement Officers (APH) to process this case as a criminal act of forgery.

“The certificate was canceled because it was defective, because of factors that violate the law. Therefore, the legal basis must be fake letters or documents,” he said.

“So, based on the cancellation carried out by the Ministry of ATR/BPN, it can be used as one of the evidences that a criminal act of forgery has occurred.

Meanwhile, the Head of Public Relations of the Ministry of ATR/BPN, Harison Mocodompis, emphasized that the ministry will continue to be committed to resolving the sea fence case according to its authority.

By ensuring that every land product is in accordance with applicable legal provisions.

“We are concentrating on the tasks and functions given by the president to review this product whether it is in accordance or not.

Taking legal steps permitted by law in order to carry out the process, whether it is cancellation or examination, both related to the product and the parties involved in the issuance,” he said.

Harison Mocodompis also reminded the public of the important role of the community in overseeing this process through the official geoportal platform of the Ministry of ATR/BPN, bhumi.atrbpn.go.id, which allows the public to check land data transparently.

“Thank you to the community who have helped in carrying out social control to ensure that the land registration process runs according to the rules,” he concluded.
