The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) held a discussion on the conceptual amendments to Government Regulation (PP) Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration.
The event took place on Wednesday (November 7, 2026) in Meeting Room 401 of the Ministry of ATR/BPN, Jakarta. The discussion aimed to increase legal certainty and protection in the land sector.
“This policy change must be able to provide legal certainty and protection, both for the public and for the Ministry of ATR/BPN officials at the central and regional levels.
The regulations developed must be clear, operational, and able to be implemented safely at the regional level,” stated the Inspector General of the Ministry of ATR/BPN, Pudji Prasetijanto Hadi, in his remarks.
The discussion on the conceptual amendments to PP Number 18 of 2021 was held as a follow-up to the evaluation of the regulation’s implementation.
In its implementation, several issues remain, such as overlapping regulations and inconsistent licensing.
Policy adjustments are also needed to strengthen legal certainty and protection in the land sector.
Pudji Prasetijanto Hadi emphasized that these changes are expected to ensure the entire substance of the regulations can be fully understood and implemented consistently.
This will prevent differences in interpretation in their implementation.
“Therefore, it is important to reiterate that each provision has its own impact and does not create impacts beyond those already regulated,” he emphasized.
During the meeting, the Director General of Land Rights Determination and Registration, Asnaedi, presented ten main concepts. These 10 concepts include:
Regulation of the governance of Land Use Rights (HGU), resolving overlapping permits as a new substance, regulating state land, and regulating reclaimed land.
Adjustment of Management Rights (HPL) provisions, cancellation of land rights due to administrative defects, conversion of HGU to Building Use Rights (HGB) or Use Rights (Hak Pakai) (HP).
Restructuring expired land rights; Legal protection in land registration.
And the obligation to report property rights for control and supervision.
The Secretary General of the Ministry of ATR/BPN, Dalu Agung Darmawan, who opened the forum, requested all relevant officials to play an active role in providing comprehensive and constructive input on the planned regulatory changes.
He assessed that the involvement of all work units is crucial so that the resulting policy can address needs on the ground while minimizing the potential for future legal issues.
“We need to expand this discussion to assess which substances need to be included and which should not. Therefore, I hope you can provide input,” said the Secretary General of ATR/BPN.
The discussion on the conceptual amendments to Government Regulation Number 18 of 2021 was attended by Middle and Primary High-Level Officials within the Ministry of ATR/BPN, both offline and online.
The Ministry of ATR/BPN is committed to continuously improving regulations to realize equitable and sustainable land governance and provide legal certainty for all stakeholders.
