The Panel of Judges at the Tangerang District Court, Banten, suggested looking for another translator to accompany the defendant, a foreign national (WNA) from Portugal, Fernando Miguel Gama De Sousa, a defendant in a cocaine drug case who was arrested at Soekarno-Hatta International Airport, Tangerang City.

“Just leave the old translator alone, according to the prosecutor, that’s suitable,” said Chief Judge M Alfi Sahrin Usuf in Tangerang, in a trial with an interim decision agenda, Tuesday (9/7/2024).

This was because the defendant Fernando objected to the translator Indah Herdinawati who had accompanied him during the two trials.

He said that try to find another interpreter and it could be presented at the next trial, it doesn’t matter if there are two people.

This is related to OC Kaligis’ lawyer requesting the panel of judges to change his client’s translator for various reasons.

Fernando even sent a two-page letter to the judge asking him to change the translator because he had been appointed by the prosecutor.

The defendant’s various reasons for not accompanying him include always communicating with another defendant, namely Rui Pedro Azevedo Viana, who is also a defendant from Portugal.

Likewise, another reason is that the translator was part of the investigative unit who witnessed the torture and beating of the defendant.

Translator Indah also lied about signing a letter or document without the presence of a team lawyer from the OC Kaligis office.

The defendant did not clearly understand what Indah was saying and had difficulty asking questions.

In the trial, the interim decision agenda stated that the lawyer’s request was rejected so that the trial continued next week with the witness examination agenda.
