Lawyer OC Kaligis urged Minister of State-Owned Enterprises (BUMN) Erick Thohir to immediately pay the Jiwasraya insurance policy worth IDR 35 billion because it already has permanent legal force.

“The court decision must be carried out because it has permanent legal force, there is no reason to pay anymore,” said OC Kaligis in Jakarta, Wednesday (2/10/2024).

Kaligis said the policy had become part of the Central Jakarta District Court decision No.219/Pdt.G/2020/PN.Jkt.Pst junto DKI Jakarta High Court Decision No. 176/Pdt/2022/PT.DKI and the Supreme Court of the Republic of Indonesia Review (PK) Decision No.96 PK/Pdt/2024.

According to him, the decision has permanent legal force and he asked the Minister of BUMN to order PT Asuransi Jiwasraya (Persero) to pay its obligations.

However, according to the court ruling, the amount calculated up to October 1, 2024 is IDR 35 billion.

He added that he had sent letters to Minister Erick Thohir dozens of times and most recently on October 2, 2024 with the number 827/OCK.X/2024 regarding the request for the implementation of the court decision.

Likewise, Kaligis has also sent similar letters dozens of times to President Joko Widodo and other authorized agencies, but until now there has been no serious response.

Kaligis initially saved at Bank BTN but there was an offer through a marketing agent from the state-owned bank that he was directed to the Jiwasraya policy with a protection plan program because he believed it belonged to the government.

In the letter, Kaligis said that the media received information that the Financial Services Authority (OJK) had ordered Jiwasraya to pay off its obligations to the protection plan policyholders.

Kaligis said that because soon on October 20, 2024 the change of the President of the Republic of Indonesia, his party reminded Minister Erick Thohir when he was inaugurated with an oath to obey and carry out orders according to the Law (UU).

“The court’s decision is the same as the law and must be obeyed,” said the Professor of the Faculty of Law, Manado State University, North Sulawesi.
