Fernando delivered his defense using Portuguese and translated into Indonesian so that it could be understood by visitors to the trial.

Fernando Miguel Gama De Sousa, a Portuguese citizen (WNA) cried while reading his defense at the Tangerang District Court, Banten, after the prosecutor demanded the death penalty.

“I think it is very unfair what happened in this court, it is very clear that the police lied and tried to slander me,” said Fernando in Tangerang, Thursday.

Fernando delivered his defense using Portuguese and translated into Indonesian so that it could be understood by visitors to the trial.

The defendant was accompanied by four attorneys Muhammad Faris, Fredy Maxi Paat, Josua Martahan Situmorang and Supriadi from the law office of Prof. OC Kaligis.

The trial chaired by judge M. Alfi Sahrin Usuf and prosecutor Raden Isjunianto listened to the delivery of the plea by Fernando who wiped away tears several times.

Fernando was charged by the prosecutor as the owner of cocaine drugs who was arrested by Polda Metro Jaya officers in the 3361 Swiss Bell Pecatu hotel room, Bali.

The prosecutor demanded another Portuguese citizen Rui Pedro Azevedo Viana who was also a suspect, but was only sentenced to 20 years in prison.

Fernando said he had never touched drugs, let alone used them, and he had been brutally attacked by the police.

During the police examination, Fernando admitted that he was tortured because he denied having the drugs.

Even several witnesses from the hotel and Customs and Excise officers did not know or see directly that Fernando had the cocaine.

However, suddenly in the hotel room there was evidence of a purple bag, scales, a pan and a plastic press and a shampoo bottle, but investigators destroyed the evidence and it was never presented during the trial, this violates Article 194 paragraph 3 and Article 39 paragraph 1 of the Criminal Procedure Code.

The indictment stated that the defendant was the owner of cocaine from Brazil, but not a single witness admitted and saw it directly, including the defendant Rui Pedro Azevedo Viana who denied it and withdrew the BAP that had been made.

Fernando said he was not a criminal and not a drug dealer and had never had problems with the police before, but the purpose of going to Bali was to vacation and surf.

“I like surfing, I love animals and I am a vegetarian and I don’t want to kill or torture other creatures,” said the 38-year-old.

He hopes the judge will be fair because as the breadwinner of the family he earns a living and wants to see his father in Lisbon, Portugal who is sick and hopes the judge will free him from all punishment.
