Lawyer OC Kaligis criticized PT Jiwasraya's actions in deliberately robbing customers of their money under the pretext of launching a Protection Plan program through Bank BTN, thereby reducing public trust in financial institutions.

Kaligis in Jakarta, Tuesday (11/6/2024) said that in the middle of 2016, his party was approached by a Bank BTN manager offering a Jiwasraya product called the Protection Plan and Bank BTN appointed seven marketing agents for the program and banks with good reputations.

"With this program, it is known that many money owners have transferred their savings to Jiwasraya," he said in a press release sent to this media.

Kaligis said that in accordance with the Law on Special Insurance article 75, Jiwasraya must be honest about its financial condition during the marketing process.

However, the aim of marketing the program is to collect customer money from banks appointed as marketing agents who are willing to transfer savings to Jiwasraya so that the crisis can be resolved.

He added that it turned out that the Attorney General exposed the Jiwasraya mega corruption carried out by its director, so that the victims were Protection Plan policy holders.

According to him, he transferred money to Jiwasraya in the form of savings of IDR 25 billion in the names of Yenny Oktarina Misnan, Prof. OC Kaligis and Aryani Novitasari with interest of 6 percent per year and interest that is not suspicious in the banking world.

Meanwhile, since 2018, Kaligis has been trying to negotiate with Jiwasraya so that the money can be returned.

Negotiations failed, finally they took legal action to the Central Jakarta District Court and were registered with registration No. 219/PDT.G/2020/PN.JKT.PST.

Kaligis won the case at the District Court, the High Court case number 176/PDT/2022/PT DKI and the Supreme Court in the judicial review decision case number 96 PK/PDT/2024.

The ruling stated that Jiwasraya was obliged to return the principal debt plus a late fine of 1 percent per month starting from the time the lawsuit was registered in May 2020, so according to Jiwasraya's calculations it had to return IDR 35 billion.

Kaligis made a press statement because it turned out that even though Jiwasraya lost in court, it still did not want to return the customer's savings.

If this is the fact, how can the laws in Indonesia be trusted by foreign investors?

He questioned the President's oath based on article 9 of the 1945 Constitution to obey the law, this also applies to Erick Thohir as Minister of BUMN who oversees Jiwasraya.
